By using this site, the user unconditionally accepts the terms and conditions of use as stated below and/or elsewhere on the site.

The user is advised to carefully read all information on products and services provided in the relevant sections.

This site is owned by TOHFAKART.COM. No material from this site or any other website owned, operated, controlled, or licensed by TOHFAKART.COM and/or its associates or sister concerns may be copied, reproduced, republished, transmitted, downloaded, uploaded, or otherwise used for commercial or any other purpose without the written permission of TOHFAKART.COM. Violation of this condition constitutes a breach of copyright and other proprietary rights of the company and/or its associates, sister concerns, or affiliates.

Once your item is picked up and safely reaches our studio, we kindly request a 50% advance payment to begin the process.
The remaining payment can be made after the artwork is completed, or you may also opt for COD for the remaining amount.

Since each piece is fully customized and crafted with utmost care, we begin the creation only after receiving the initial payment.

If the advance payment is not completed after we receive the item, the order will be placed on hold and may be cancelled, following which we will safely return your item. In such cases, a two-way shipping charge (minimum ₹500) will be applicable.

The products/services provided on this site are offered without warranties of any kind, either expressed or implied. TOHFAKART.COM disclaims all such warranties to the fullest extent. TOHFAKART.COM does not guarantee that the products/services will be error-free, that defects will be corrected, or that this site or the server that hosts it will be free of viruses or other harmful components. Any warranties or after-sales services, if provided by manufacturers/vendors, shall be handled directly by them. TOHFAKART.COM is not obligated to ensure compliance or handle related complaints.

There may be additional charges such as octroi, taxes, or duties, which must be borne by the recipient at the time of delivery. Please note that TOHFAKART.COM does not control these charges.

For perishable items such as flowers or sweets, delivery will be attempted only once. If delivery fails due to an incorrect or insufficient address, the recipient being unavailable, the premises being locked, or refusal to accept the item, the customer will still be charged. No refunds will be entertained in such cases.

Since gift arrangements are handmade, there may be slight variations from the images shown. However, we will ensure the delivered product closely matches the description and photograph.

Product specifications (weight, size, color, etc.) are approximate. Most products are handmade, so variations may occur. TOHFAKART.COM, at its sole discretion, may deliver a similar or alternate product due to reasons beyond its control.

Under no circumstances shall TOHFAKART.COM be liable for any loss of data, loss of profits, or any damages, including but not limited to indirect, special, incidental, or consequential damages resulting from the use or inability to use the products/services on the site. In any event, TOHFAKART.COM’s total liability shall not exceed the amount paid by the user for the specific product or service.

TOHFAKART.COM strives to provide the most current information. However, the contents, products, and services may change from time to time without notice. Prices and availability are subject to change without notice. Online prices may not reflect local selling prices. We reserve the right to limit sales, including to re-sellers. We are not responsible for typographical or photographic errors.

For users who have availed services via TOHFAKART.COM through listed providers, TOHFAKART.COM may contact them via SMS, email, call, or WhatsApp after their appointment to request feedback or provide updates. TOHFAKART.COM owns this feedback process.

Notwithstanding anything stated in the above terms, FAQs, or elsewhere on the site, any refund or payment made by TOHFAKART.COM to a user or third party, voluntarily or upon claim, does not constitute a waiver of the stated terms. It shall not set a precedent for future actions or confer any rights on the claimant. All such refunds, if any, will be subject to a 10% deduction for bank and processing charges.

Additional Policies:

  • Complaints: An unboxing video is required to raise any complaint regarding breakage or missing items.

  • Order Confirmation Calls: If a customer places an order but is unaware or forgets about it, our team will attempt to call 2–3 times within a month. If the customer does not respond, the order will be automatically canceled, and no refund will be issued.

  • Delivery Delays: Due to COVID-19, deliveries may be delayed. Once dispatched, TOHFAKART.COM is not responsible for whether the order arrives on the estimated delivery date.

  • Working Days Notice: Orders may be delayed beyond the working days mentioned in the product description due to unforeseen circumstances.

  • Customized Rakhi Note: Customized MDF Rakhis for Raksha Bandhan will come with a silver dial instead of a golden one.

  • Rakhi Combo Variations: Normal Rakhi in combo packs may vary depending on availability. It is stated in the product description that the delivered item may differ slightly from the one shown.

  • Photo Box Policy: If the customer does not specify a photo for the gift box, the space may be left blank (white background).

  • Mini Cushion: Rakhi will be delivered without a mini cushion.

  • Product Variation: Delivered products may slightly differ in color or shape from the images shown.

  • Sweets in Diwali Combos: We use rasgullas or soan papdi as per our discretion and may use our own or third-party packaging. We do not guarantee sweets from specific brands like Haldiram or Bikano.

  • Express Delivery: Delivery within 6 hours is available in selected zip codes.

  • Cut-off for Express Delivery: Orders placed after 6 PM will be delivered the next day between 10 AM and 3 PM under the 6-hour delivery option.

Jurisdiction and Dispute Resolution

By using TOHFAKART.COM, the user confirms having read, understood, and agreed to all terms, conditions, and risks associated with using the site. Ignorance of these terms will not be accepted as an excuse.

In the event of any dispute, both parties agree to attempt amicable resolution. If unresolved within 30 days, the matter shall be referred to a sole arbitrator under the Arbitration and Conciliation Act, 1996. All disputes shall be subject to the jurisdiction of courts located in Bareilly, India.
